...the rich and powerful generally have access to better legal counsel, and more of it, which helps them to steer clear of legal issues before they occur, and steer them out when they do. If they do go to trial, it typically doesn't last very long and generally ends in some kind of settlement rather than jail time. Every now and then, though, someone does wind up there.
Whether that constitutes tilting, I would have to say probably not. I don't think the US judicial system was originally designed to favor anyone, but obviously, just like in most aspects of life, if you have money, it generally means you have an advantage. That said, the judicial system is not perfect, not everyone has the same superior legal counsel, and so whether or not prejudices exist, mistakes are made, errors occur, and innocent people end up in jail.
Actually, we have a legal system in which two counsel fights from opposite side. The counsel who is cleverer and more intelligent, will win the case. It means we don't have a system which we have designed to find the truth. In reality we have made a system where the quality of the counsel is the most important things. It depends on the ability of the counsel that he/she can make a criminal free and in other conditions he/she can bring death sentence to an innocent person as well.
So, this is the system where money matters the most. Justice has no place in such a system. I am not saying this about a particular country but, this is the common phenomenon all over the world.
I agree. I think some are better than others at it, but in the end, it will come down to the ability of legal counsel to work a case. Which doesn't always equate to justice. However, in the case of the criminals, if they get off once, they did to find ways to get back in front of a judge and jury, so in those cases of repeat offenders, they're bound to trip over their own ego, arrogance, ineptness or compulsion, however you wish to define it.
It would be good if both sides of the equation were working towards justice and truth, rather than solely the best interests of who they represent. A lot more guilty and a lot less innocent would end up in prison.
